These Terms and Conditions ("Terms") together with our Privacy Policy and any other written information brought to your attention before confirming your booking, govern the use of Tukio ("Platform"), and constitute a legally binding agreement between Tukio Booking Ltd (Company number: 15630500) of registered address: 71-75 Shelton Street, London, England, WCH 9JQ ("Platform", "we", "us", "our") and its Guests ("Guests", "you", "your"). By accessing or using the Platform, Guests agree to abide by these Terms.

The Tukio platform offers a digital venue that enables travel service providers ("Hosts") to publish and offer services, and enables users (or "Guests") to search, book or use the services offered by the Hosts. Hosts offer their accommodation, transportation and activity services in their properties in a "Listing" published by the Platform. By listing their property and other services on the Platform, Hosts agree to abide by these Terms.

As provider of the digital venue, Tukio does not own, control, operate or manage any Host Services. Tukio acts in the capacity of Principal in the sale of non-flight inclusive packages, and 'single service' booking. Where transportation such as flight is included in the package, the Host is responsible for holding the necessary licenses and Tukio acts solely as the booking intermediary.

In the event that your booking consists of a 'Package' (where more than one service is booked at an inclusive or total price) then you will receive the rights and benefits under the Package Travel and Linked Travel Arrangements

Regulations 2018 ("PTRs").

Acceptance of Terms

  • 1.1. By using the Platform, Guests acknowledge that they have read, understood, and agree to these Terms.

  • 1.2. The Platform reserves the right to modify these Terms at any time without prior notice. Guests are encouraged to review the Terms periodically for updates.

User Accounts and Registration

  • 2.1. Guests must be at least 18 years old to create an account on the Platform.

  • 2.2. Guests agree to provide accurate, current, and complete information during the registration process.

  • 2.3. Guests are responsible for maintaining the confidentiality of their account information and passwords.

  • 2.4. Guests agree to notify the Platform immediately of any unauthorized use of their account.

Booking and Reservations

  • 3.1. The Platform facilitates the booking of Host Services that may include accommodations, activities, meal plans, and transportation services. However, the Platform is not responsible for the quality of services provided by the hotels.

  • 3.2. Guests must provide accurate booking information, including dates, number of guests, and special requests.

  • 3.3. When you book a Listing you agree to pay all charges for your booking in the checkout process under the "Total Price". You are also agreeing to Tukio to charge the preferred Payment Method. When you receive the booking confirmation, a contract for Host Services, a "Reservation" is formed directly between you and the Host. In addition to these terms, you will be subject and responsible for complying with all terms of the Reservation, including the cancellation policy and any other requirement defined on the Listing.

  • 3.4. Guests are responsible for confirming that you, and anyone accompanying you in any of the Host Services provided, meet the minimum age, proficiency, fitness or other requirements. You are responsible for informing the Host of any medical or physical conditions or any other circumstances that may impact your ability to participate, attend, or use a Host Service.

  • 3.5. Guests and Hosts are responsible for any booking modifications they agree to make via the Platform or Tukio's customer service to make on their behalf, and agree to pay any additional amounts, fees or taxes associated.

  • 3.6. Tukio will generally charge the Total Price stated in the checkout due after the Host accepts your booking requests. Unless otherwise stated in the checkout process, the payment will be charged in full at the time of confirmation of the booking, i.e. "Reservation". We reserve the right to return your payment and decline to issue a booking confirmation at our absolute discretion.

  • 3.6. Payment for bookings is made through secure payment gateways integrated into the Platform. The Platform is not liable for any financial transactions between the Guest and the payment gateway.

  • 3.7 Please note that the services outlined on the provisional booking confirmation will not be fully confirmed until the final confirmation detailing your booking reference number(s) have been provided. This is usually sent within 24 hours. Should we be unable to provide the requested services or provide those services at the prices quoted, we will, where possible, offer alternatives or a full refund. We shall not be liable to pay you compensation.

  • 3.8 If we do not receive payment in full and on time, we reserve the right to treat your booking as canceled by you in which case the cancellation charges set out in clause 4.1 below will become payable.

  • 3.9 Adequate travel insurance is a condition of your contract with us. Details of a policy suitable to cover the arrangements you book are available by contacting us. If you choose to travel without adequate insurance cover, we will not be liable for any losses howsoever arising, in respect of which insurance cover would otherwise have been available.

Cancellation and Refund Policy

4.1. Guests must review the cancellation and refund policy during the booking process. Standard cancellation policy will be applied as follows:

Intellectual Property

  • 5.1. The Platform owns all intellectual property rights, including but not limited to logos, trademarks, content, and software used on the Platform.

  • 5.2. Guests agree not to use, copy, modify, distribute, or reproduce any content from the Platform without prior written consent.

User Conduct

  • 6.1. Guests agree to use the Platform in compliance with all applicable laws and regulations.

  • 6.2. Guests are prohibited from engaging in any unlawful, harmful, abusive, or disruptive activities on the Platform.

  • 6.3. Guests must not upload, post, or transmit any content that infringes upon the rights of others or violates these Terms.

Disclaimer of Warranties and Limitation of Liability

  • 7.1. The Platform makes no warranties regarding the accuracy, reliability, or completeness of any information or content on the Platform.

  • 7.2. The Platform shall not be liable for any damages arising from the use or inability to use the Platform.

  • 7.3 We reserve the right to amend the price of unsold holidays at any time and correct errors in the prices of confirmed or advertised holidays.

Disclaimer of Warranties and Limitation of Liability

  • 7.1. The Platform makes no warranties regarding the accuracy, reliability, or completeness of any information or content on the Platform.

  • 7.2. The Platform shall not be liable for any damages arising from the use or inability to use the Platform.

  • 7.3 We reserve the right to amend the price of unsold holidays at any time and correct errors in the prices of confirmed or advertised holidays.

Termination

  • 8.1. The Platform may, at its sole discretion, terminate or suspend a User's account for violations of these Terms or any other reasons.

  • 8.2. Upon termination, the User's access to the Platform and any associated services will be immediately revoked.

Events Beyond our Control

9.1 Except where otherwise expressly stated in these Booking Conditions we will not be liable or pay you compensation if our contractual obligations to you are affected by Events Beyond Our Control. For the purpose of these Booking Conditions, this means any event beyond our, or our supplier's control, the consequences of which could not have been avoided even if all reasonable measures had been taken. Examples include warfare and acts of terrorism (and threat thereof), civil strife, significant risks to human health such as the outbreak of serious disease at the travel destination or natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely to the travel destination or remain at the travel destination, the act of any government or other national or local authority including any port or river authorities, industrial dispute, labour strikes, lock closure, natural or nuclear disaster, fire, chemical or biological disaster, unavoidable technical problems with transport and all similar events our or the supplier(s) concerned's control.

Governing Law and Jurisdiction

10.1. These Terms shall be governed by English Law.
ny disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales only.
